Effective date: November 1, 2026
These Terms & Services ("Terms") govern your access to the website simplycarsbuyers.com (the "Site") operated by Simply Cars Buyers ("Company," "we," "us," or "our") and your use of information, tools, and forms made available through the Site in connection with extended auto warranty and vehicle service contract offerings ("Products"). By accessing the Site or submitting information through any form, you agree to these Terms. If you do not agree, do not use the Site.
The Site provides educational content, plan summaries, and request forms related to extended warranty and vehicle protection plans. Displayed pricing, coverage highlights, and marketing descriptions are illustrative unless confirmed in a signed service contract issued to you. Nothing on the Site constitutes a binding offer until you receive and accept a formal contract with complete terms, exclusions, waiting periods, deductibles, and cancellation rights.
Simply Cars Buyers may act as a marketer, administrator, or agent for third-party obligors or insurers depending on the Product selected. The identity of the contractual obligor, if different from Simply Cars Buyers, will be disclosed in your service contract documents.
You must be at least eighteen (18) years of age and possess the legal authority to enter into contracts to request quotes or enroll in Products. By submitting information, you represent that all details provided about yourself and your vehicle are accurate and complete to the best of your knowledge.
Coverage is subject to underwriting guidelines including vehicle age, mileage, condition, maintenance history, commercial use, modifications, salvage or branded titles, and prior mechanical failures. We reserve the right to decline enrollment or limit available tiers based on inspection results or documented pre-existing conditions. A waiting period and odometer threshold may apply before full benefits become active, as specified in your contract.
Quote requests submitted through the Site are non-binding. Final premium, deductible, contract term, and covered components are determined after review of your vehicle information. You are responsible for reviewing the entire contract, including the schedule of covered parts, exclusions, definitions, claim procedures, and transfer provisions before signing.
To pursue a covered repair, you must follow the claim steps outlined in your contract, which typically include:
Unauthorized repairs, failure to mitigate further damage, or misrepresentation of vehicle condition may result in claim denial. We may require photos, diagnostic scan data, or tear-down inspections to validate coverage.
All Products exclude non-covered items listed in your contract, which commonly include wear-and-tear maintenance, cosmetic damage, intentional abuse, racing or competition use (unless endorsed), rust, environmental damage, and failures caused by lack of recommended maintenance. You must maintain your vehicle according to manufacturer guidelines and retain service records. Improper modifications that contribute to a failure may void coverage for affected components.
Roadside assistance, rental reimbursement, trip interruption, and similar riders are governed by separate benefit limits, event caps, and coordination rules in your contract. Benefits may require use of designated dispatch networks. Reimbursement claims must include itemized receipts within stated time limits.
Transfer of a contract to a new vehicle owner may be permitted for an administrative fee if eligibility criteria are met. Cancellation rights, refund calculations, and pro-rata rules vary by Product and obligor policy. Statutory cancellation windows may apply from the contract effective date. Contact us through the email on the Site for cancellation instructions specific to your plan.
You agree not to misuse the Site, including attempting unauthorized access, introducing malware, scraping content at scale, impersonating others, or submitting false vehicle data. We may suspend access for conduct that threatens Site integrity or violates applicable law.
All Site content, logos, graphics, text, and layout are owned by Simply Cars Buyers or licensed to us and protected by intellectual property laws. You may view and print pages for personal, non-commercial use. You may not reproduce, distribute, or create derivative works without written permission.
The Site may reference repair networks, payment processors, or educational resources operated by third parties. We are not responsible for third-party sites, their privacy practices, or service quality. Your interactions with repair facilities are subject to their own terms, though we will coordinate payment for approved claims as described in your contract.
THE SITE AND GENERAL MARKETING CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. COVERAGE DECISIONS ARE MADE ACCORDING TO YOUR EXECUTED SERVICE CONTRACT, NOT WEBSITE SUMMARIES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLY CARS BUYERS AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM SITE USE, QUOTE REQUESTS, OR RELIANCE ON MARKETING MATERIALS. OUR AGGREGATE LIABILITY RELATED TO SITE USE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO ACCESS THE SITE (WHICH IS ZERO FOR PUBLIC BROWSING), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.
You agree to indemnify and hold harmless Simply Cars Buyers from claims arising out of your misuse of the Site, inaccurate submissions, or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
By providing your email address or phone number, you consent to receive transactional and marketing communications related to warranty Products. You may opt out of marketing messages as described in our Privacy Policy. Electronic contract delivery and electronic signatures may be used where permitted by law.
Our collection and use of personal information are described in the Privacy Policy, which is incorporated into these Terms by reference.
We may update these Terms periodically. The effective date at the top will reflect revisions. Continued Site use after changes constitutes acceptance. Material changes to enrolled contracts, if any, will be handled according to those contracts and applicable law, not solely by website updates.
These Terms are governed by the laws of the state in which the obligor identified in your service contract is organized, without regard to conflict-of-law rules, except where consumer protection laws of your residence mandate otherwise. Disputes related to Site access or marketing shall be resolved through binding arbitration or courts as specified in your service contract or, if none applies, in courts of competent jurisdiction.
If any provision is held unenforceable, remaining provisions remain in full force.
